Mrs.Srivastava, learned AGP appearing for the Applicants, on instructions, states that salary of the employee for the period, which is subject matter of the Civil Applications, was not paid and therefore the Civil Applications are infructuous.

Mr.Bandiwadekar, Counsel appearing for the employee states that salary has been paid for the period which is the subject matter of the CA and subsequently the matter has been adjudicated by the Education Officer, who passed an order adverse to the employee. This has been challenged in a Writ Petition and the Writ Petition is still pending. Thereafter, 2/3
3/3 Mr.Bandiwadekar states that the Deputy Director passed an order cancelling the approval, against which, a second Writ Petition is filed and stay has been granted in that Petition.

Mrs.Srivastava states that all these issues can be decided in two Writ Petitions, which are pending.

Civil Applications are disposed of with no order. Applicants are at liberty to raise all their contentions before the writ Court in the two pending Writ Petitions.
