The applicant is apprehending arrest in C.R. No.635 of 2021 registered with Dehu Road Police Station, Pimpari Chinchwad, for offence under Section 135 of the Indian Electricity Act. It is alleged that the applicant has taken unauthorized electricity connection for the residence and committed theft of electricity. The value of which is around of Rs.3,89,500/-.

Learned Advocate for the applicant has produced receipt of payment of depositing Rs.1,50,000/- with the Maharashtra State Electricity Distribution Company Ltd on 10.10.2022. The receipt is taken on record. Without giving findings about claim of complainant, with liberty to complainant to recover the amount by SAJAKALI LIYAKAT JAMADAR Date:

Learned APP submitted that the mode of theft of electricity adopted by the applicant needs to be considered. He was involved in committing theft of electricity in the sum of Rs.3,89,500/-. 4.

Considering the observations made herein above this application can be allowed.

ORDER

i.

Anticipatory Bail Application No.2520 of 2022 is allowed;

ii.

In the event of arrest of the applicant in connection with C.R. No.635 of 2021 registered with Dehu Road Police Station, Pimpari Chinchwad, the applicant be released on bail on furnishing P. R. Bond in the sum of Rs.20,000/- with one or more sureties in the like amount;

iii.

The applicant shall attend the investigating officer on 19th, 20th & 21 of October, 2022 between 11.00 a.m. to 1.00. iv.

Anticipatory Bail Application stands disposed of accordingly.
