This is an application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of bail.

The applicant came to be arrested in Crime No. 123 of 2022 registered at Manchar Police Station, Pune for the offences punishable under Sections 307, 326 of Indian Penal Code, Section 4 r/w. 25 and 27 of the Arms Act and Section 135 of the Maharashtra Police Act. 3.

According to the prosecution, on the date of incident which took place on 27 March 2022 the present applicant assaulted the complainant by koyta and attempted to kill him on account of some previous dispute.

It appears that the applicant is in jail for more than one year. In view of the order passed by this Court dated 30 March 2023, the applicant has paid Rs.75,000/- towards medical expenses to the complainant/injured. Considering the overall facts and circumstances, I am inclined to release the applicant on bail. Hence, the following order is passed :

(i) Application is allowed.

(ii) The applicant - Santosh Kacharu Rajgude be released on bail in Crime No. 123 of 2022 registered at Manchar Police Station, Pune for the offences punishable under Sections 307, 326 of Indian Penal Code, Section 4 r/w. 25 and 27 of the Arms Act and Section 135 of the Maharashtra Police Act, on furnishing P.R. Bond in the sum of Rs.25,000/- with one or two sureties in the like amount. (iii) The applicant shall attend the police station once in a month i.e., on first Saturday between 11.00 a.m. to 2.00 p.m. till conclusion of trial.
