Heard learned counsel appearing for the petitioners and Mr.

Mandar Limaye, learned counsel representing the respondents-Thane Municipal Corporation.

Under challenge in this petition is an order dated 8th June, 2023 to the extent it blacklists the petitioner-firm. 3.

Against the said order dated 8th June, 2023, the petitioner-firm, an appeal dated 20th June, 2023 has been filed before the Commissioner, Thane Municipal Corporation, Thane, in terms of Clause 18 of the conditions of tender/ work order.

Learned counsel for the petitioners confines his prayer for issuing a direction to the Appellate Authority/ Commissioner, Thane Municipal Corporation to expedite the proceedings of the said appeal.

Accordingly, having regard to the innocuous prayer made by the learned counsel for the petitioners, this petition is finally disposed of with a direction to the Commissioner, Thane Municipal Corporation, Thane, to expedite the proceedings of the appeal said to have been filed by the petitioners on 20th June, 2023, a copy of which has been enclosed as Exhibit "P" to the writ petition, and conclude the same within maximum period of two weeks from today.

We also direct that the decision on the appeal preferred by the petitioners shall be taken strictly in accordance with law.

It is needless to observe that we have not made any observation as to the merits of the claim of the respective parties.

This order shall be communicated to the Commissioner, Thane Municipal Corporation, Thane, by the learned counsel representing the Corporation forthwith.
