By this Civil Application, the Applicant is seeking condonation of 100 days delay in filing the First Appeal challenging the judgment and award dated 02.03.2009 passed by the Civil Judge, Senior Division, Tq. Barshi, Dist.

Solapur in LAR No.66/2002 holding that the Respondent-Claimant is entitled to additional compensation of Rs.1,42,000/- towards the acquired land admeasuring 4H 50Rs.

Considering the submissions made by the learned AGP for the Applicant and Basavraj G. Patil 1/2

21.4164.16-caf.odt the averments made in the Civil Application, I am satisfied that the Applicant has made out a case for allowing the Civil Application.

Hence, following order is passed.

Delay in filing the First Appeal is condoned.

Civil Application stands disposed of accordingly.
