The learned counsel for respondent no. 1 submitted that he will file Writ Petition before the High Court challenging the order of the trial Court.

In view of this submission, the order dated 27th April, 2010passed by the learned Ad-hoc District Judge-5 and Assistant Sessions Judge, Pune is hereby set aside and the original order passed by the trial Court is hereby restored. The suit is restored. If the respondents wants to challenge the said order of allowing condonation of delay by taking appropriate proceedings, it is to be taken within a month from today.
