Heard the learned counsel appearing on behalf of the appellant and the respondent.
In the present case Part-I Award passed by the Industrial Court is challenged by filing Writ Petition in this Court. The learned Single Judge confirmed the Part-I Award and against Gaikwad RD 1/2
(917)LPANo.242009 the said order present appeal is filed by the Management. It appears that this Court at the time of admitting the appeal has directed that the Part-II proceedings should not be stayed. We are informed that the Part-II proceedings are going on. It is submitted, by consent of both the parties, that the order passed by the learned Single Judge be set aside and hearing of the Part-II Award be expedited.
We, therefore, set aside the order passed by the learned Single Judge. We are directing the Industrial Court to expedite the hearing of the Part-II Award proceedings. Needless to state that, in the event any adverse order is passed against the Management in the Part-II Award proceedings, they will be entitled to challenge both Part-I and Part-II Awards. (A. M.
