The applicant is seeking regular bail in Crime No. 251 of 2015 for the offences punishable under Section 397 read with Section 34 Indian Penal code and Sections 3, 25 of the Arms Act. 2).

Chargesheet in the matter is already filed. There are no criminal antecedents. Though the applicant was identified in the identification parade, however, nothing was recovered from him. The maximum punishment provided under Section 397 Indian Penal Code is of 7 years. The offence is triable by the Magistrate.

Hence, the Bail Application is allowed. The applicant, be released on bail on furnishing P.R. Bond of Rs.25,000/- (Rs. Twenty Five Thousand only) with one or two sureties in the like amount. 4).

Any two consecutive absence of the applicant before the learned Magistrate will entail the learned Judge to adopt appropriate proceedings for cancellation of bail. 5).

The applicant to attend police station as and when called. 6) The applicant shall not tamper with the evidence and/or influence the witnesses in any manner whatsoever. (N.W. SAMBRE, J)
