We have heard learned Counsel for the petitioner. 2.

The learned Counsel for the petitioner seeks directions against the respondents to remove unauthorized construction raised by one Dayadhan Namanand Bille on the writ property. The learned Counsel submits that though there are orders passed by the Civil Court, the cognizance has not been taken. The petitioner is benefciary of the order of the Civil Court. The petitioner has been communicating with the respondents time and again, but no cognizance has been taken.

The writ property, it appears, is subject matter of the decree of a Civil Court. The parties are at liberty to proceed ahead pursuant to the orders of the Civil Court. The decree Gaikwad RD 1/2

11.WPNo.110502022.doc can be executed in accordance with the provisions of Code of Civil Procedure. The parties may take appropriate steps in that regard.

With these observations, the writ petition is disposed of. No costs.
