1] The learned counsel for the Applicant states that he has been served with the notice under Section 41A of the Cr.P.C. but on account of some health issues, he has not reported to the Investigating Officer. 2] Considering the operative mandate issued by the Hon'ble Apex Court in the case of Satender Kumar Antil vs. CBI, since the Investigating Officer has followed the mandate, let the Applicant be bound by it.

3] Let the Applicant report to the Investigating Officer within a period of 7 days from today.

(24)ABA-2530-2022.doc The Investigating Officer shall follow procedure prescribed under Section 41A of the Cr.P.C. and record reasons in case if he comes at a conclusion that custodial interrogation of the Applicant is very much necessary for completing the investigation.
