Learned counsel Mr.Purwant states that the applicant is ready to deposit an amount of Rs.2,37,000/- with the complainant, the proprietor of S.R.Motors.

2/3 11 ABA-2531-22.doc Learned A.P.P. Mr.Gavand, who was asked to verify whether this was the amount, which was received by the applicant, on the basis of the instructions and on verifying the bank statement, makes a statement that the applicant has received an amount of Rs.3,05,777/-.

Upon being confronted, learned counsel for the applicant states that the applicant shall pay the entire amount as stated by the learned A.P.P. within a period of two weeks from today. Subject to the compliance of the aforesaid statement, the applicant deserve protection from arrest, with a liberty being reserved in the complainant as well as in the prosecution to seek cancellation of bail, if the said statement is not honoured. : ORDER :

(a) Application is allowed.

(b) In the event of arrest in connection with C.R.No.158 of 2022 registered with Kongaon Police Station, applicant-Anand Neharu Nirhali shall be released on bail on furnishing P.R. Bond to the extent of Rs.25,000/- with one or two sureties in the like amount. (c) The applicant shall deposit an amount of Rs.3,05,777/- in the account of the complainant within a period of two weeks from today.

(d) The applicant shall report to the concerned police station as and when called for.

(e) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing the facts to Court or any Police Offcer and shall not tamper with evidence.

In view of the disposal of the application, interim application does not survive and stands disposed off. ( SMT. BHARATI DANGRE, J.)
