Learned APP upon instructions submits that the applicant has criminal antecedents in as much as 13 offences are registered against the applicant and in the present case, he is charged with an offence punishable under section 376 of the Indian Penal Code. In view of this, it would not appropriate to consider the application under section 439 of the Code of Criminal Procedure, 1973. The application stands dismissed.
