Heard. The learned counsel for the Petitioner and Respondent Nos.1 and 2 submit that the matter is settled out of court. They tendered minutes of order dated 28.02.2020 duly signed by the advocate for the Petitioner as well as Respondent Nos.1 and 2. Same are taken on record and marked "X" for identification, which read thus:. MINTUES OF ORDER The following minutes of order is passed by consent of the parties:- 1/3
The Petitioner hereby withdraws the above Petition.
The Respondent No.1 hereby states that they have decided to recall the Tender No.:TMC/ CE/ EM/ ESS/ 2015-16/eNIT/04 dated 28.12.2015 for the work of Design, Supply, Installation, Testing and Commissioning of State of the Art IP based Surveillance System for TMH Complex Electronic Surveillance System CCTV and issue fresh Tender for the aforesaid nature of work. The Respondent No.1 hereby further states that the Petitioner shall be at the liberty to participate in the aforesaid new tender process subject to the Petitioner qualifying as per the terms of the Notice inviting the said new Tender, on its own merits, and on complying with the terms and conditions of the said new tender document,. without being influenced by the disqualification of the Petitioner from Tender No.: TMC/CE/EM/ESS/2015-16/eNIT/04 dated 28.12.2015.
The present Writ Petition has not been heard 2/3
and decided on merits.
The Writ Petition No. 10678 of 2016 and pending Interim Application No.1 of 2020 therein are disposed off accordingly.
No order as to costs.
