1] Heard learned Counsel for the applicant. Respondents are not present, though served.
2] This application is for condonation of delay of 257 days in filing of the above C.R.A. In the application it is averred that the applicant had original filed writ petition in this court challenging the impugned orders. On 7th July 2016, this Court took up the said petition and passed an order that the writ petition be converted into C.R.A. Petitioner, however, was not represented and was not aware
YBG 17-cac-661-16.doc of the said order, so as to take steps to convert the petition within the time. Accordingly the contention of the applicant is that the office has raised an objection of a delay of 257 days in converting the writ petition into C.R.A. I have perused the application. The reasons stated in the application are bonafide. It is also not the case that the applicants had not preferred the initial proceedings belatedly. It is thus in the interest of justice that the application is allowed. It is, therefore, allowed in terms of prayer clause (a). (G.S.KULKARNI, J.)
