Not on board. On being mentioned, taken on board. These applications are filed by applicant for suspension of sentence and for grant of bail. Heard learned counsel for both the sides. Perused the documents filed with the accompanying revision application. It is found that applicant came to be convicted by the learned Metropolitan Magistrate's court, Mazgaon, Mumbai, for the avk 1/3
offence punishable under Section 3 read with Section 25 of Arms Act, 1951, and is sentenced to suffer rigorous imprisonment for 3 years and to pay a fine of Rs.10,000/-, in default, to suffer imprisonment for 6 months.
Appeal preferred by applicant before the learned Sessions court appears to be partly allowed and by order dated 3rd September 2016, conviction imposed upon applicant for the offence punishable under Section 3 read with Section 25 of Arms Act came to be modified thereby imposing sentence of rigorous imprisonment for 1 year. It is no case of prosecution that while on bail, applicant has misused the liberty granted to him.
Considering the sentence imposed upon applicant, applications are liable to be allowed as per the order below : i) Applicant shall be released on bail on his executing P.R.Bond in the sum of Rs.15,000/- with one surety in like amount.
ii) While on bail, applicant shall mark his presence with Pydhonie Police Station once in three months, on the first day of such month.

iii) Applicant shall produce his proof of residence to the Investigating Officer and intimate change of address in future, if any, to the concerned police station. iv) Both the applications stand disposed of as allowed. (P. N. DESHMUKH, J.) avk 3/3
