The applicant is seeking bail in CR No.I-196 of 2015 dated 19-05-2015 registered with Waliv Police Station, DistPalghar under section 376 of the Indian Penal Code. 2.
The learned counsel for the applicant submitted that at the time of registration of offence, the victim was about 17 years of age. That the applicant was having an affair with the victim. However, as applicant was married person he could not perform the marriage with the victim girl. He further submitted that the personal law of the applicant and the victim girl permits second marriage and applicant infact intends to the marry with the victim girl. 34-ba-1786-2015 mother of the victim girl i.e. complainant has also filed an affidavit dated 07th January 2016 in that behalf. However, as this Court was not inclined to release the applicant on bail, the learned counsel for the applicant on instructions submitted that, he may be permitted to withdraw the present application with a direction to the Trial Court to expedited the trial as the victim girl has now become major and still she is intending to marry with the applicant.

In view of the above the present application is allowed to be withdrawn. The learned Trial Court seized of the Trial arising out of CR No. I-196 of 2015 registered with Waliv Police Station, Dist-Palghar is hereby directed to conclude the trial within a period of six months from the date of receipt of this order.

The application is disposed of in the aforesaid terms.
