P.C. :- By this Application the Applicant seeks condonation of delay of 83 days in filing an Appeal against Acquittal. We have heard the learned Counsel appointed for the Applicant and the learned Counsel representing the Respondents and the learned APP representing Respondent No.1. The learned Counsel for the Respondents have opposed the condonation of delay on the ground that sufficient explanation has not been given by the Applicant for seeking condonation of delay.

We have perused the Application as well as the affidavit and in our opinion, the Applicant has explained the delay. Accordingly, we allow this Application and condone the delay with no order as to costs.
