The learned APP, on instructions from the Investigating Officer make a statement, that pursuant to the notice issued under section 41 A of Cr.P.C, the applicant has reported to the Investigating Officer and she has rendered all her cooperation. Learned APP also state that the amount of Rs. 25,000/- is deposited with the Investigating Officer. The complainant is represented by Advocate N.K. Sharma, and since the only accusation faced by the present applicant is the amount extorted from the complainant, let the Investigating Officer return the amount to the complainant. Ashish Mhaske

2/2 31.doc In the wake of the above, since the learned APP state that custodial interrogation of the applicant is not necessary, the following order shall protect her interest.

: ORDER :

(a) Application is allowed.

(b) Applicant - Nilofar Salim Mulani shall be released on bail in connection with C.R.No.395/2022 registered with Jogeshwari on furnishing P.R. Bond to the extent of Rs.25,000/- with one or more sureties in the like amount. (c) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing the facts to Court or any Police Officer. The applicant shall not tamper with evidence.
