Heard learned Counsel for the applicant.

By this application, the applicant seeks pre-arrest bail in connection with C.R. No.349 of 2017, registered with the Bandra Police Station, Mumbai, for the alleged offence punishable under Section 363 of the Indian Penal Code.

Learned Counsel for the applicant submits that the applicant

2/2 919-aba.1770.2019.doc was arrested in the aforesaid C.R. on 23rd October, 2017 and on the very same day, he was released on bail. He submitted that the applicant has received a notice from the Bandra Police Station, asking him to remain present for filing of the charge-sheet in the trial Court on 21st August, 2019. 4.

Learned APP states on instructions, that the police do not intend to arrest the applicant in the aforesaid C.R., inasmuch as, the applicant was arrested in the present C.R. earlier on 23rd October, 2017 and on the very same day, he was released on bail. She further states on instructions, that the applicant is only supposed to remain present on 21st August, 2019, as the police intend to file a charge-sheet on the said date in the Court of the learned Metropolitan Magistrate and therefore the question of arresting the applicant does not arise. Statement accepted. 5.

In view of the statement made by learned APP, nothing survives for consideration in this application. Application is accordingly disposed of.
