Heard learned Counsel for the petitioner. Rule. Rule is made returnable forthwith.

Mr. Rajendra Pednekar, who is stated to be the authorized

signatory of the respondent no.2 is present before the court. Learned Counsel for the respondent no.2, on instructions from the authorized signatory of the respondent no.2 submits that the respondent no.2 does not want to proceed against the petitioner (accused no.4 in the Criminal Complaint Nos. 3192/SS/2013, 4111/SS/2013, 1564/SS/2014, 33/SS/2013, and 2324/SS/2012 pending on the file of the Metropolitan Magistrate's 33rd Court, Ballard Pier, Mumbai. He further submits that the respondent no.2 has no objection to allow the petitions and quash the proceedings as against the petitioner-accused no.4. He therefore seeks leave to withdraw the writ petitions.

In the light of the aforesaid statement, the writ petitions are allowed. The process issued by the learned Metropolitan Magistrate, 43rd Court, Borivali, Mumbai, vide order dated 16.6.2014, in C.C.Nos. 3192/SS/2013, 4111/SS/2013, 1564/SS/2014, and vide order dated 21.02.2013 in C.C. 33/SS/2013, and 2324/SS/2012 is quashed and set aside qua the petitioner-accused no.4 Mr. Shantanu Narayan Rooj. (ANUJA PRABHUDESSAI, J.)
