This Appeal is preferred by the New India Assurance Company Limited against the judgment and Award dated 21st March, 2011 passed by the Motor Accidents Claim Tribunal, Mumbai in M.A.C.P. No. 292 of 2011.

The parties to the Appeal have settled the claim and arrived at consent terms executed on 8th December, 2018. The consent terms are taken on record and marked X-1 for identification.

Respondent no.1 is present before the Court. The consent terms are explained to him. He admits the same. The copy of the Aadhar Card of respondent no.1 is also taken on record as proof of identity. The Appeal stands disposed of in terms of the consent terms.

In view of disposal of the Appeal, Civil Application No. 23874 of 2018 taken out for stay, becomes infructuous and does not survive. The same is also disposed off.
