Heard learned Counsel for the applicant.

By this application, the applicant seeks pre-arrest bail in connection with C.R. No.162 of 2019, registered with the MIDC Police Station, Mumbai, for the alleged offences punishable under Sections 420, 406 r/w 34 of the Indian Penal Code.

Perused the papers. According to the complainant - Santosh Bane, he wanted to purchase a premises under the Slum Redevelopment Scheme, pursuant to which, he approached the applicant and one Mukesh Bhandari. According to the complainant, he gave a sum of Rs.9,50,000/- both in cash and by cheque to Mukesh Bhandari and to the applicant. It is not in dispute that the entire amount has been recovered from the coaccused - Mukesh Bhandari. The applicant has no antecedents. 4.
Learned APP also does not dispute the same.

Considering the aforesaid, the custodial interrogation of the applicant is not necessary, in the facts. The application is accordingly allowed and the applicant is granted pre-arrest bail on the following terms and conditions :
ORDER
(i) In the event of the arrest, the applicant be enlarged on bail on executing P.R. Bond in the sum of Rs.10,000/- with one or two sureties in the like amount ;
3/3 (ii) The applicant shall report to the Investigating Officer of the concerned Police Station on 22nd August, 2019 and 23rd August, 2019, between 10.00 a.m. to 12.00 noon;
(iii) The applicant shall co-operate with the Investigating Agency. 6.
The Application is allowed in the aforesaid terms and is accordingly disposed of.

It is made clear, that the observations made herein are prima facie and are confined to this application.
