This application received through Jail is for expeditious hearing of Special Case No. 4 of 2015, pending in the Sessions Court at Mumbai before the Special Judge trying Maharashtra Control of Organised Crime Act matters. Ms. Dabholkar, the learned APP states that the Sessions Court has kept the matter on 20th February, 2017 for framing the charge. She also states on, instructions, that in all six persons are involved in the Sessions Case, in which five including the applicant have been arrested and one is still absconding.

Dusane 2/2 appln536.2016 Since the Sessions Court has given a specific date for framing of the charge, it will have to be presumed that the trial in the Sessions Case would start soon thereafter. Therefore, no directions for expeditious hearing are required to be passed at this stage. Hence, the application is dismissed. (Smt. R.P. SondurBaldota, J.)
