The criminal application is filed for condoning the delay of 122 days occurred in filing the aforesaid appeal against conviction. By the impugned order, the applicants are convicted of offence punishable under Section 302 of the Indian Penal Code, 1860 and sentenced to suffer life imprisonment. The applicants have explained the delay by making averment in paragraphs 2 and 3 of the application. We find the explanation to be satisfactory. We, therefore, allow the criminal application by condoning the delay of 122 days. The criminal application is, accordingly, disposed of.
