In view of the statement made by the learned A.P.P., on instructions, the learned counsel for the applicant does not press this application and seeks leave to withdraw the same with liberty to file a fresh application, after filing of charge-sheet, before the Sessions Court. Application is accordingly disposed of as withdrawn with liberty as prayed.
