Heard learned counsel for the applicant and the learned APP for the respondent - State. 2.

By this application, the applicant seeks modification/relaxation of the condition imposed in para 4 clause (iv) of the order dated 27.07.2015 passed by this Court (CORAM : MRS.MRIDULA BHATKAR, J.) in B.A.No.1362 of 2015.

The condition of which modification/relaxation is sought reads thus :-

"iv) The applicant shall stay out of the jurisdiction of the village Dahiwadi and Satara City for a period of 4 months from today, except when he is required to attend the Court dates and immediately thereafter, shall get out out of the Satara city."

Learned counsel for the applicant states that the applicant has not entered the jurisdiction of village Dahiwadi and Satara City for more than three months. He submits that earlier the applicant had sought relaxation for one day to enter the Satara City to attend the Panchayat Samittee meeting on 27.08.2015. He submits that this Court (REVATI MOHITE DERE, J.) had relaxed the said condition for one day to enable the applicant to attend the said meeting. He submits that the applicant has not misused the liberty granted to him.

Learned APP does not dispute the fact that the applicant has complied with the

aforesaid order and has stayed out of the jurisdiction of Satara City and village Dahiwadi for more than three months, i.e. till date.

It appears that charge-sheet has been filed in the said case. Since the applicant has complied with the order till date i.e. for three months + three days, the said condition of not to enter village Dahiwadi & Satara City stands relaxed/modified. Accordingly, the applicant is now permitted to enter Satara City and village Dahiwadi. Rest of the conditions imposed vide order dated 27.07.2015 stand as it is.

The Application stands disposed of.

All parties to act on the authenticated copy of this order.
