This is an application under Section 439 of the Cr.P.C. for bail in CR No.5/E/2013 by CBI (EOW) under Sections 465, 467, 471, 409, 420 r/w.12-B of the Indian Penal Code.

The prosecution case as against the applicant is that, the applicant and co-accused in connivance with each other forged some of the Lcs and those were encashed through a bank account, which was in the name of the applicant.

The record indicates that the co-accused namely Mr. Govind Salgaonkar, who has been similarly situated that of the applicant has been released on bail by the learned Special Judge-CBI, Gr. Bombay by its Aarti Palkar 1/2

57.BA.2044.17.doc Order dated 11.03.2016. The record clearly indicates that the role played e is little lesser than that of co-accused Govind Salgaonkar, and therefore, the applicant is entitled to be released on bail on the ground of parity. 4.

Hence, the following order.

(a) The applicant be released on bail in CR No.5-E of 2013 by CBI EOW on his furnishing PR bond of Rs.4 Lacs with one or two solvent local sureties in the like amount.

(b) After his release from Jail, the applicant shall attend the office of CBI on every first Monday of the month between 11.00 a.m. to 1.00 p.m. till conclusion of trial.

(c) The applicant shall attend all the dates before the Trial Court unless precluded by medical reasons.

(d) The applicant shall not leave India without prior permission of the Trial Court.

(e) The applicant shall not tamper with the evidence and/or pressurize the prosecution witnesses.
