DATE : 26TH SEPTEMBER, 2018 P.C:- 1) This is an application under Section 439 of Criminal Procedure Code for bail filed by the aforesaid applicants who have been arrested in Crime No. 300 of 2018, registered at Miraj City Police Station, for offences punishable under Sections 307, 323, 504 read with section 34 of Indian Penal Code and under section 4, 25, 27 of Arms Act and under section 37 (1)(3) read with Section 135 of the Mumbai Police Act.

2) Heard Umesh Mankapure, learned counsel for the applicant, and Mr. Yadav, learned APP for the State. Perused the records and considered the submissions advanced by the learned Counsels for the respective parties.

3) The aforesaid crime was registered pursuant to the by Radhakishan Shivlal Ladda Date:

first information report lodged by one Abhishek Sahadev Chavan. A perusal of the first information report, prima facie, reveals that applicant no.1 with the help of other co-accused tried to inflict injuries on the first informant Abhishek Chavan. The first information report indicates that he had avoided said blow and he had not sustained any injury. The applicants were arrested on 4/8/2018 and are presently in magisterial custody. Presence of the applicants is no longer required for the purpose of interrogation or investigation. The applicants are permanent residents of Miraj. There is no possibility of their absconding. The learned APP submits that the applicants have no criminal antecedents.

4) Considering the above facts and circumstances, in my considered view, this is a fit case for grant of bail. Hence, the following order:- (i) Application is allowed.

(ii) The applicants be released on bail in CR No. 300 of 2018 registered at Miraj Police Station, Sangli, on their furnishing bail bonds of Rs. 25, 000/- each with one or two sureties in the like amount. (iii) The applicants shall attend all the dates before the Trial Court, till conclusion of the trial.

(iv) The applicants shall furnish their permanent and temporary addresses, if any, and their contact details to the Investigation Officer.

(v) The applicants shall not change their residential address without prior intimation to the Investigation Officer.

(vi) The applicants shall not interfere with the complainant/first informant, other witnesses and shall not tamper with the evidence in any manner. Application is disposed of in the aforesaid terms. (SMT. ANUJA PRABHUDESSAI, J.)
