By this writ petition, the petitioner challenges the notification dated 21.06.2013, as far as it relates to the properties mentioned in prayer clause 'A' of the petition. The learned Assistant Government Pleader has tendered an additional affidavit-in-reply in the Court today. It is stated that the allocation of the lands in the instant petition as per the draft development plan of Trimbak Municipal Council is submitted to the State Government under the provisions of the Maharashtra Regional and Town Planning Act. It is stated that after the Trimbak Municipal Council had proposed for necessary modifications, the approval of the State Government is requested for. It is stated that the Government has not accorded approval to such modifications and/or the draft development plan till date.

Sudhir Rane 927-WP-8633-2013.doc The learned counsel for the petitioner states that in view of the submissions made in paragraph nos. 8 and 9 of the additional affidavit-in-reply, the petitioner would avail the other remedy, if necessary.

In view of the aforesaid statement, we dispose of the writ petition with no order as to costs.
