By this Application, the Applicant who is the Appellant in First Appeal No.2201/2011 has sought withdrawal of the amount of Rs.1,15,20,000/- deposited by him before this Court in pursuance of the order dated 09/07/2012 and 31/08/2012 passed in Civil Application No.4592/2011 in First Appeal No.2201/2011. 2.

Learned counsel for the Applicant, under instructions, states that Applicant will withdraw the application filed before Civil Judge, Senior Division, Pune for similar relief. Statement is accepted. 1/2

Learned counsel for the Respondent Nos.2 and 3 who are the contesting parties, have no objection for withdrawal of the amount. 4.

In the light of the said statement and in view of the reasons stated in the Application, the Applicant/original Appellant is permitted to withdraw an amount of Rs.1,15,20,000/- along with interest accrued thereon.
