Heard the learned Counsel for the petitioner. 2.

Order dated 06.06.2022 passed in Writ Petition No.8759/2021 records categorical statement of the petitioner, that he shall vacate the suit premises by handing over possession to the respondent-Slum Rehabilitation Authority, on or before 13.06.2022 by 10.00 a.m. The statement was accepted as an Undertaking to this Court.

Since petitioner did not hand over the possession on or before 13.6.2022, a notice was issued under Section 33/38 of the Maharashtra Slum Act on 8.9.2022. This notice is challenged in this petition.

In consideration of the facts of the case and order dated 06.06.2022 passed in Writ Petition No.8759/2021, I am not inclined to stay execution of impugned notice dated 08.09.2022.

The petition is rejected.
