Since the Petitioner has not exhausted the remedy available to him under Section 44 of the Maharashtra Recognition of Trade Unions and Prevention of Unfair Labour Practices Act, the above Writ Petition is dismissed. However, the Petitioner is granted liberty to move the learned Industrial Court under Section 44 of the said Act.
