In pursuance of the order passed by this Court, the petitioner was admitted in Sassoon Hospital, Pune on 21st March 2018 to 24th July 2018. Thereafter, petitioner has granted furlough leave for the period of 28 days i.e. between 25th July 2018 to 23rd August 2018. Under the provisions of Government Circular under Rule 3(4) of Maharashtra Prisons (Mumbai Furlough and Parole) Rules, 1959, furlough cannot be granted for more than 28 days. We, therefore, cannot entertain this petition.

2/2 (909)WP-3679-18.doc Be that as it may, the learned APP on instructions of Mr.N.M. Kamble, Jailor, who is present in the Court makes a statement that if the petitioner needs medical treatment, he will be admitted in Sassoon Hospital at Pune. Statement accepted. The petitioner is at liberty to apply for parole. Learned counsel for the petitioner, on instructions of petitioner's wife who is present in the Court, states that tomorrow i.e. 24/8/2018, the petitioner is to be given Dialysis. In view of the statement, we grant liberty to the petitioner to surrender to the Jail Authorities on 25th August 2018 subject to above. In the light of the statement made herein above, the Jail Authorities are directed to take necessary steps for the treatment of petitioner's Dialysis, whenever required, in future. Petition is accordingly dismissed.
