It appears that First Appeal No. 671 of 2014 came to be dismissed for want of filing of paper book within a period of one year as directed by this Court ( CORAM: K.K. TATED,J.) vide order dated 23rd March, 2015. Now, by way of present application which is admittedly moved after 3 years and 139 days, the condonation of the same is sought for restoration of the said dismissed First Appeal No. 671 of 2014.

22-CAF-3511-2019.DOC Learned counsel for the respondents has not seriously disputed the averments made in the application which attributed towards delay. For the reasons stated in para 4 of this application, the same are accepted and the delay stands condoned subject to payment of costs of Rs. 5000/-. Accordingly, the delay of 3 years and 139 days for restoration of the First Appeal No. 671 of 2014 stands condoned on depositing costs of Rs.5000/- with the office of Maharashtra State Legal Services Authority.

Learned AGP makes a statement that she would file a paper book within four weeks from today which is also accepted. Civil Application stands disposed of accordingly. List the First Appeal on 31st January, 2020.
