Heard learned counsel for the parties.

On the last date the Complainant was directed to be added as a Respondent. The Complainant is personally present. He states that he does not want to engage any advocate. 3.

The record discloses that on 29 November 2021 it was directed that the Applicant shall not be arrested. This was on the basis of the statement on behalf of the Applicant that the Applicant is ready and willing to deposit Rs.1,94,734/- before the learned Magistrate. The learned counsel for the Applicant states that the amount has been deposited as per the Demand Draft dated 4 December 2021, copy of which is produced on record. N.S. Kamble page 1 of 3

The amount has been deposited before the Judicial Magistrate First Class, Panvel. The learned counsel for the Applicant states that the Applicant has no objection if the said amount is withdrawn by the Respondent-Complainant.

I have heard the learned counsel for the parties,. 5.

Looking to the nature of the allegations and the fact that the Complainant has deposited the amount, the following order is passsed.

ORDER

(i) In the event of his arrest in connection with investigation of Crime No.20 of 2021 registered with NRI Sagari Police Station, the applicant-Akshay @ Prathamesh Ashok Vengurlekar shall be released on bail on executing a P.R. Bond in the sum of Rs.20,000/- with one or two solvent sureties in the like amount.

(ii) The applicant shall report to the Investigating Officer as and when called by the investigating officer and shall co-operate with the Investigating Agency. (iii) The Respondent-Complainant is at liberty to withdraw the amount of Rs.1,94,734/- deposited N.S. Kamble page 2 of 3

before the Judicial Magistrate First Class, Panvel along with interest, if any.

(iv) If such an application is made by the Respondent-Complainant, the Magistrate shall pass appropriate orders as per law.

(v) The Criminal Application is disposed of in the aforesaid terms.
