This Civil Application is taken out by the petitioner wife against respondent husband for setting aside the order passed in the above Review Petition No.92 of 2015 which dismissed Review Petition challenging the order dated 14th June, 2013 passed in Writ Petition filed by the petitioner wife being Writ Petition No.2379 of 3.

Her income as a means of maintaining herself came to be seen in the order of the Family Court and in the Writ Petition. Her case on merits came to be considered and the order came to be passed. The petitioner wife sought review which has been dismissed after hearing the advocate of the petitioner wife. There is not reason to set aside the said order in the review petition. 4.

This Civil Application has been taken out on 10th

jsn CAW No.2867_2015 September, 2015. It appeared on board since 15th October, 2015. It has been adjourned from time to time to 17th October, 2015, 23rd October, 2015 and 26th October, 2015. It is not shown to be served. It is in fact seen to be misconceived and a bid to bind time. It is for the petitioner wife to proceed to trial in the trial Court and prove her claim on merits. It is seen that the petitioner has sought to delay such hearing.

Civil Application is misconceived and is dismissed with costs of Rs.3,000/-.
