Learned counsel for respondent nos.2 and 3 submits that this appeal is being put up for production at the instance of respondent nos.2 and 3 and notice has been accordingly served on the advocate for the appellant. It is submitted that this Appeal from order has become infructuous for the reason that the appellant/plaintiff has withdrawn the suit being Suit being S.C.Suit No.2117 of 2010. This appeal arises from an interlocutory order dated 2nd August, 2011.

This appeal from order is accordingly dismissed as infructuous.
