This Application is made by the opposite party for condonation of 256 days delay in preferring the appeal challenging the award dated 04/10/2013 passed by the MACT, Thane in MACP No.267/2004.

Considering the submissions made by the learned counsel for the Applicant and the averments made in the Application, I am satisfied that the Applicant has made out a case for allowing the present Civil Application.

Hence, the following order:
a) Civil Application is allowed in terms of prayer clause (a) which read thus:
(a) the delay of about 256 days caused in filing the above First Appeal may kindly be condoned and the above appeal be heard on merits.
b) Civil application stands disposed off accordingly.
c) Office is directed to place the Civil Application No.32/2016 on board on 15/01/2016.
d) In the meantime, the Applicant to complete service in Civil Application No.32/2016, on or before 15/01/2016.
