The applicant was granted interim relief by an order dated 4.9.2017. It is the allegation against the applicant that he instigated accused No.1 Dattatraya Bhandalkar to assault Amol Pawar with sickle. The said assault was the result of earlier enmity between the applicant and his group members on one side and the brother of the first informant on the other side. The record of investigation reveals that co- accused Dattatraya Bhandalkar and Udya Gaikwad have been arrested by the police and the weapons used in the present crime have already been recovered at the instance of accused Dattatraya Bhandalkar.The role attributed to the present applicant is that he instigated the accused Dattatraya Bhandalkar to commit the said offence.

In view thereof, according to me, the custodial interrogation of the applicant for further investigation of crime is not necessary, however he can be directed to attend the Investigating Officer and to join the process of investigation. Hence, the following order.
a) In the event of arrest of the applicant in CR No.206 of 2017 registered with Jejuri Police Station, District Pune, he shall be released on bail on his furnishing PR bond of Rs.25,000/- with one or two solvent local sureties in the like amount.
b) The applicant shall attend the Investigating Officer as and when called for till the submission of final report between 10.00 a.m. to 2.00 p.m. and to join the process of investigation.
c) The applicant shall not tamper with the evidence and/or influence the prosecution witnesses.
d) Application is allowed in the aforesaid terms. (A.S.GADKARI, J.)
