By this Application, the Applicant is seeking transfer of Divorce Petition pending before the Civil Judge Senior Division, Solapur to Civil Judge Senior Division, Kalyan. 2.

It is contention of the learned counsel for the Applicant that, the Applicant stays at Kalyan with her parents. The Applicant is finding difficult to attend the Court dates at Solapur. The distance between Kalyan to Solapur is more than 400 k.m. Hence, requested to allow the Application. 3.

45-MCA-279-2023.doc no sound reasons are given for the transfer. Hence, requested to dismiss the Application.

I have heard both learned counsel.

The Applicant stays with her parents at Kalyan. The distance between Kalyan to Solapur is more than 400 k.m. Considering the reasons mentioned in the Application as well as it is settled principle of law convenience of the wife has to be considered while transferring the Petition over the husband. 6.

In view of above, I pass following order.

ORDER

(i) The Marriage Petition No.120 of 2022 pending before Civil Judge Senior Division, Solapur be transferred to Civil Judge Senior Division, Kalyan (ii) Both the parties to appear before the concerned Court on 6th May 2024.

(iii) The Application is allowed and disposed of.
