Learned counsel for the appellant states that the parties have already settled the disputes in execution proceedings by an order dated 7th October 2016 and seeks liberty to withdraw this First Appeal. 2.

First Appeal is dismissed as withdrawn. Refund of Court Fees as per rules. Office is directed to transmit statutory deposit of Rs.25,000/- to the concerned trial Court expeditiously. No order as to costs.
