This is an application for condonation of 234 days delay in preferring the revision application by the State against the order of discharge of Respondent No.1. Respondent No.1 appeared in person and vehemently opposed the application. He submitted that delay is more than 300 days. In view of the ratio laid down by the Supreme Court in the case of Collector, Land Acquisition and anr. Vs. Mst. Katiji and ors. reported in AIR 1987 SC 1353, it appears that delay is not deliberate and intentional. In view of the same, delay is condoned subject to the condition that the applicant shall pay costs of Rs.1000/- to the Maharashtra State Legal Service Authority within a period of 3-weeks from today.
