The Appellate Court, by the impugned order, has rejected the petitioner's application for remand of appeal on the ground that the petitioner intend to remeasure the suit property. 2.

The Appellate Court in paragraph 8 has kept the issue of remeasurement open for hearing and necessary orders to be decided at the time of final adjudication of the appeal. Therefore, no interference in the impugned order is called for. 3.

The writ petition is dismissed. No costs.
