The learned counsel appearing for the Pune Municipal Corporation has placed on record a letter dated 16th June, 2015, addressed to him by the Joint Municipal Commissioner, LBT, Pune Municipal Corporation.

On instructions, he states that the Municipal Corporation shall withdraw the order dated 4th September, 2014, (Exhibit - 'A' to the

2/2 48-wp.8830.2014 petition). He submits that a liberty may be granted to the Municipal Corporation to take action in accordance with law as indicated in the letter dated 16th June, 2015.

The letter dated 16th June, 2015, is taken on record and marked 'X' for identification. We accept the statement made on instructions that order dated 4th September, 2014, which is impugned in this petition, shall be withdrawn.

In view of the aforesaid statement, nothing survives for consideration in this petition, the same is disposed of. However, we make it clear that it will open for the Municipal Corporation to take action in accordance with law as requested.

All contentions on merits are kept open.
