Heard the learned counsel for the applicant.

This application is for bringing legal heirs on record of deceased appellant no.3, Aksharsaheb Baiuddeen Inamdar, who died on 21.6.2015.

The present Civil Application is fled on 10.9.2015 i.e. within time.

Considering the submissions made by the learned counsel for the Applicant and the averments made in the Application and as application is filed within time, I am satisfied that the Applicant has made out a case for allowing the present Civil Application. Hence, following order: a) Applicant is permitted to bring legal heirs Mohite 1/2

21 cas1616-15.doc on record of deceased appellant no.3 in Second Appeal (ST) No.29826 of 2014 and pending Civil Application if any within 8 weeks from today, failing which Civil Application shall stand dismissed without referring back to the court.

b) Civil application stands disposed off accordingly.
