Smt. Pai, learned PP, on instructions, submits that the petitioner was tried in Sessions Case No.285 of 2002 before the Sessions Court at Mumbai and was convicted for the offence punishable under Section 302 of the Indian Penal Code, 1860. She further submits that the petitioner is undergoing the sentence in Nashik Road Central Prison, Nashik. 2.
The grievance of the petitioner is that he has been booked in C.R.No.I-40/1998 for the offences punishable under Sections 307, 323, 504 and 34 of I.P.C. registered with Vishnu Nagar Police Station, Dombivali and the trial arising out of the said crime is still pending before the Sessions Court, Kalyan. He, therefore, prays for expeditious trial. 3.
In that view of the matter, if the trial arising out of the aforesaid crime is still pending, we direct the concerned Sessions Court at Kalyan to expedite the trial and conclude the same as expeditiously as possible, and in any case, within one year from the date of receipt of a copy of this order. Needless to observe that on effective dates of hearing, the petitioner shall be 1/2
18_WP3521_17.doc produced before the concerned Court. We hope and expect that the parties to the trial will extend full co-operation for early conclusion of the trial in case the trial is not concluded yet.

With the above observations, writ petition stands disposed of. 5.
