After approaching the Civil Court for recovery of money due to the petitioner, on the assurance of the respondents, the petitioner withdrew the Suit. It is the grievance of the petitioner now that the respondents backed out from paying the balance amount of the bill due to the petitioner. We would be slow in entertaining the Petition after party approaches the Civil Court on the same cause of action. 1/2

27. wp 11167.16.doc Learned Counsel appearing for the respondents, on instructions of Mr.Milind Kapile- Executive Engineer of Pimpri Chinchawad Municipal Corporation who is present in Court, submits that final bills will be submitted to the concerned auditor within two weeks from today. Payment of the remaining amount due to the petitioner will be made within two weeks after the auditor clears the bill.
