The Petitioner has sought a direction to the Respondent Nos. 3 to 6 to release and pay the grant in aid in respect of the Petitioner's salary admissible to the post of Assistant Teacher with effect from April 2019.

We note that the Petitioner had made a grievance to the Deputy Director of Education, Pune and the Deputy Director of Digitally signed by ATUL GANESH KULKARNI Date:

agk 2 12-aswp9082-2021.doc Parishad, Pune by communication dated 18 January 2019. The Deputy Director had made reference to earlier communication that the Petitioner's salary should be resumed. Pursuant to this communication, the Education Officer has submitted a report on 7 September 2020 wherein the Education Officer has raised certain doubts and objections and thereafter it appears that no further orders are passed by the Deputy Director.

Since the Deputy Director has already taken cognizance of the grievance of the Petitioner and has called for a report from the Education Officer with certain prima facie observations in favour of the Petitioner, it is not necessary for us to look into the controversy, except to direct the Deputy Director to proceed further. 5.

The Deputy Director will take a decision pursuant to his communication referred to earlier after considering the papers in respect of the Petitioner and the papers and objections raised by the Education Officer within a period of eight weeks from today and communicate the outcome to the Petitioner and the Respondent - Management.
