The learned APP has placed on record a report dated 21st March, 2017 submitted to him by the Senior Inspector of Powai Police Station. The report records that on 14th September, 2015 the police have filed a final report claiming 'B' summary and notice of the said report has been issued to the first informant.

In view of filing of the report claiming 'B' summary, it is not necessary to entertain this application for quashing the FIR. Accordingly, the application is disposed of. In the event 'B' summary is not accepted by the learned Magistrate, it will be open for the applicant to file a fresh application seeking quashing of the FIR. All contentions on merits are kept open.
