It appears from record that the appellant-Insurance Company has deposited an amount of Rs.45,32,500/- pursuant to the order of the Trial Court dated 27/04/2017 passed in MACP No. 856 of 2010.

Applicants are allowed to withdraw 50% of the deposited amount and the said amount is to be distributed amongst the Rekha Patil 1/2

37-1-FAST-13166-18.DOC applicants as per the calculation given in clause-3 of the operative order of the Trial Court dated 27/04/2017.

The applicants are further directed to give an undertaking of returning the said amount to be withdrawn in the event of appeal being allowed with prevailing rate of interest. Civil Application is allowed and is accordingly disposed of. (V.G.BISHT, J. ) Rekha Patil 2/2
